Terms of Use for the Boats.zone Portal Services

Contracting Parties

Boats.zone is a website operated by the company European Business Solutions s.r.o., Budatínska 20, 85106 Bratislava, IČO: 54230012, hereinafter referred to as the operator.

The website allows users to publish and search for offers of boats, goods, services, and other property of private individuals and business entities, hereinafter referred to as users. Boats.zone is not a seller; it is an online advertising platform serving users.

The following General Terms of Use regulate the use of the online advertising platform (hereinafter the "advertising platform") on the website www.boats.zone.

Services, Rights, and Obligations

Boats.zone services are provided to users free of charge. An exception is the additional features of individual services. An additional feature of the service is understood as an above-standard option or function, the activation of which is not a necessary condition for using the basic functionality of the Boats.zone service.
The operator reserves the right to make necessary changes to the advertisement or not to publish it at all, or to remove the advertisement if it is in violation of the valid laws of the Slovak Republic, these conditions, or good morals, even without a prior request for correction and without compensation.
The operator has the right to delete an advertisement that, in its discretion, does not meet these conditions or if the advertisement is placed in the wrong section with respect to the advertisement's text, or if the advertisement gives the impression that another legal or natural person is the user, even without a prior request for correction and without compensation.
The user is aware that if they want to remove the advertisement before the expiration of the publication period, they must do so themselves using the functionality available after logging into their account.
The inserted advertisement will be published free of charge for a period of 6 months. After this period, it will be automatically deleted along with all the data entered by the user during input. Upon deletion, the user will receive a confirmation email about the removal of the advertisement.
The operator only facilitates contact between the seller and the buyer and does not assume any guarantees for the quality, origin, delivery, acceptance, payment, or usability of the offered boats, services, and items.
The operator is not responsible for the misuse of user's personal data stated in the advertisement or obtained by illegal penetration into the system of the third party. The user agrees to the anonymous use of registration and statistical data.
The operator is not responsible for the activities of users of Boats.zone services or for the way in which Boats.zone services are used. The operator assumes no responsibility for any misuse of the server's services by users or third parties.
The operator is not responsible for damages that may directly, indirectly, or accidentally arise for users or third parties due to or in connection with the use of Boats.zone services. It is not responsible for damages that may arise for users or third parties due to the inability to use Boats.zone services or directly or indirectly related to this fact.
The user is responsible for ensuring that the content of the offer and/or photos or other files attached to the advertisement do not violate the rights of third parties. The operator is not responsible for interventions in the rights of third parties by the advertiser.
The user is responsible for the content of the offer. The operator assumes no responsibility for the content of the offer. The user is obliged to comply with these conditions and the relevant legal regulations when entering the advertisement.
In the event that the user attaches to the advertisement photos of which they are the author, they grant the operator, at the moment of placing the advertisement on the server or within the mobile application, a free non-exclusive license to use the photos for the duration of the offer's publication on the server or within the mobile application and for methods of use in accordance with the server's and mobile application's designation and in accordance with these conditions.
The user may not attach to the advertisement photos from advertisements of other sellers originally taken of the goods being sold.

Advertisements must relate to the sale of boats, services, and items related to boats according to the categories available on the advertising platform.
The advertiser must place the product in the appropriate product category. They may not place multiple advertisements for the same product in different categories or one advertisement for multiple products unless the advertised products are part of the main items and accessories or multiple parts of the same product.
After creating an advertisement, it is possible to change the product description only in cases where the identity of the product does not change. Subsequent changes to the brand and model are therefore not possible.
In the context of advertising, the promoted product must be described completely and truthfully. The basic features of the product must be stated (especially the condition, including any defects).
If the advertisement includes prices, specify the total prices that include all mandatory fees, taxes (e.g., VAT for sales to businesses), and other components of the price.
Data stored by the advertiser must not contain any scripts or other elements that request or download user data or other data, or automatically access websites or send content outside the advertising platform. It is also prohibited to use scripts that replace Boat24 scripts, modify records in the Windows registry, or otherwise write data to the user's hard drive. Attempts to obfuscate the source code, including the use of the Unescape function in the JavaScript language, are prohibited.

Statements

The operator declares that it devotes and will devote itself to the management of Boats.zone services with the utmost effort and professional care to minimize all potential risks that may arise to users or third parties when properly using the Boats.zone service.

Additional Features

One-time promotion of the offer with the premium service
Offers with the paid premium service will be prioritized over unpaid offers, and the offer will receive the label "premium."

The one-time premium service cannot be canceled as the service has been irreversibly provided.

Violation of Conditions, Account Suspension, Termination

If a user violates our conditions, they may be blocked. The duration of the blockage depends on the severity of the violation and your previous activity.

Advertising Tools

We take various measures to promote the advertising platform and individual advertisements, such as publishing advertisements on partner portals through iFrames and similar interfaces, creating other language versions of advertisements set in the system, marketing and advertising the platform through print advertising and other media, as well as SEO and SEA measures. When publishing advertisements on partner portals, personal data is not transferred to partner portals.

To display ads to visitors on our websites, we use the services of third-party advertising companies. These companies may use information (excluding your name, address, email address, or phone number) about your visits to these and other websites to provide ads about goods and services that interest you.

Applicable Law and Jurisdiction

With regard to entrepreneurs, Slovak law applies, with the exception of the UN Convention on Contracts for the International Sale of Goods.
In relation to entrepreneurs, the place of jurisdiction for all disputes arising from the contractual relationship between the company Boats.zone and the user is Bratislava.

The operator is entitled to modify or innovate the services of the server without the consent of users and also without their prior notice.

These conditions take effect and become effective at the moment of their publication. The operator reserves the right to change these conditions.

Language

In some cases, we may provide you with certain material in a language other than Slovak. However, all other communication and notifications according to these conditions must be in Slovak. If we provide you with a translation of these conditions, it will only be for your convenience, and the Slovak version will prevail in all cases over the translated version. We do not assume any responsibility for the content or accuracy of the translated versions of these conditions.
